SHINE GYMNASTICS PARTICIPANT WAIVER

I HEREBY ACKNOWLEDGE THAT I AM A LEGAL GUARDIAN FOR ALL STUDENT(S) ASSOCIATED WITH THIS FAMILY ACCOUNT and I assert that I have full legal authority to enter into this agreement on behalf of all minor(s) associated with this family account.  As a legal guardian of my designated student(s), I hereby consent to all student(s) participating in SHINE Gymnastics LLC program(s). 

I hereby grant permission for my child to participate in all activities at SHINE Gymnastics LLC. and all activities associated with SHINE Gymnastics LLC. that may be held at a different site or location.  As with any physical activity, I understand that there are limitless risks involved both bodily, emotionally, spiritually and/or physically.  These risks include, but are not limited to; minor injuries such as: cuts, scrapes, abrasions and bruises and/or major injuries such as: sprains, breaks, twists, and tears; and/or catastrophic injuries such as: paralysis and even death; and/or property damage such as: vehicle, cell phone, jewelry, etc.

I further understand that no matter how careful a coach is or how capable a gymnasts’ skill level and/or how many mats, spotters and/or safety precautions have been implemented, risk is always present and injury is always possible.

 I hereby grant permission to any employee of SHINE Gymnastics LLC. to use reasonable first-aid measures, and I give my full consent for treatment in the event that medical attention and/or action of any first aid measure(s) which are considered the actions of the “Good Samaritan” laws and course of action. 

 Should an accident occur, I agree to use my own insurance or other means to cover any and all expenses associated with injury, medical, legal and/or other damages incurred to my child, my student(s), my vehicle or other property that may result from participation in any activities associated with SHINE Gymnastics LLC.  

By participating in any event at SHINE Gymnastics LLC., I give my permission for my child/children(s) name(s), picture(s) and/or image(s) to be used for promotion, advertising and/or any other purpose(s).  These images are the property of and sole proprietary rights of SHINE Gymnastics LLC.  

 Further, by signing this waiver, I agree to release my right to sue, and/or pursue any course of legal action against SHINE Gymnastics LLC., its owner/owners, employees, board members, coaches, staff and/or administrators.  I hereby voluntarily release and hold harmless SHINE Gymnastics LLC., its owner/owners, employees, board members, coaches, staff and/or all other persons and entities from any and all liability, claims, actions, or rights of actions which are related to and/or are in any way connected with mine, or my child's/children’s  participation in any activities associated with SHINE Gymnastics LLC. including, but not limited to the negligent act, or omissions of SHINE Gymnastics LLC., its owner/owners officer, members, servants, agent employees and/or all other persons and entities associated with these activities. 

I further agree, promise and covenant not to sue, assert or otherwise maintain, any claim against SHINE Gymnastics LLC., its owner/owners officer, members, servants, agent employees and/or all other persons and/or entities associated with, commented with and/or associated with the activities of SHINE Gymnastics LLC.  

I understand that this waiver is intended to be broad and as inclusive as permitted by the laws of the State of Tennessee and agree that if any portion is invalid, the remainder of the waiver will continue in full legal force and effect.  I further agree that the venue for any legal proceedings shall be within Bedford County, Tennessee.

I understand that SHINE Gymnastics LLC. is not a Daycare Facility nor required to be licensed by the state as a childcare agency. 

 I affirm that I am of legal age and by selecting the agreement button I am freely signing this agreement.  I have read this waiver and fully understand that by selecting the agreement button I am signing this waiver, and by doing so I am giving up legal rights and or remedies which may be available to me for the ordinary negligence of SHINE Gymnastics LLC or any person listed above.  I acknowledge that I have had the opportunity to read, fully understand, ask questions and seek independent legal counsel regarding this release.
